Local Board of Building Code Appeals

The Local Board of Building Code Appeals directs its attention to new construction, which relates to provisions and enforcements of provisions of the Virginia Uniform Statewide Building Code entitled, "New Construction."

Board of Building Code Appeals

Any person aggrieved by the Building Code Official’s application of the Virginia Uniform Statewide Building Code or the refusal to grant a modification to code requirements may file an appeal to the Local Board of Building Code Appeals. The appeal must be filed within 30 calendar days of the receipt of the Building Code Official’s decision.

Who can apply for the appeal?

The owner of a structure, the owner's agent or any other person involved in the design, construction or maintenance of the structure may file an appeal to the Local Board of Building Code Appeals.

Who does make the final decision?

The board has the power to uphold, reverse or modify the decision of the official by a concurring vote of a majority of those present.

The Local Board of Building Code Appeal consists of 7 members appointed by the City of Chesapeake City Council for a five-year term.

How do I file the application?

An applicant must complete a City of Chesapeake Board of Building Code Appeals Application, remit a twenty-five dollars fee, and submit the application to the Building Code Officials.

Can I re-appeal if I am not satisfied with the final decision?

After final determination by the City of Chesapeake Board of Building Code Appeals, you may appeal to the State Technical Review Board. The application must be submitted to the State Technical Review Board within 21 calendar days of receipt of the decision to be appealed. Failure to submit an application for appeal within the time limit established by this section shall constitute an acceptance of the City of Chesapeake Board of Building Code Appeals official's decision.
